TO THE FULLEST EXTENT ALLOWED BY LAW, PURE WATER AND ITS OWNERS, EMPLOYEES, AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR SMS PROGRAM. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM THE SITE OR SMS PROGRAM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) $100. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the maximum extent permitted.
You agree to indemnify and hold Pure Water harmless from claims arising out of your misuse of the site, your violation of these Terms, or your violation of any law in connection with the site or SMS program, except to the extent caused by our willful misconduct.
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Venue for disputes relating to the site or these Terms lies in the state or federal courts located in Washoe County, Nevada, unless applicable law requires otherwise.
